𝗖𝗔𝗡 𝗛𝗜𝗚𝗛 𝗖𝗢𝗨𝗥𝗧 𝗕𝗘 𝗔𝗣𝗣𝗥𝗢𝗔𝗖𝗛𝗘𝗗 𝗜𝗙 𝗣𝗢𝗟𝗜𝗖𝗘 𝗥𝗘𝗙𝗨𝗦𝗘𝗦 𝗧𝗢 𝗥𝗘𝗚𝗜𝗦𝗧𝗘𝗥 𝗙𝗜𝗥 ?

Even a common man knows how Problematic it is to get the #FIR registered? On one ground or other #Police refuses to register FIR. What is the remedy then ? Shall we approach #HighCourt / #DistrictJudge / #MagistrateCourt for the registration of FIR or shall Superintendent of Police be approached ?


As per the law laid down by #SupremeCourt in the matter of 𝑀. 𝑆𝑢𝑏𝑟𝑎𝑚𝑎𝑛𝑖𝑎𝑚 𝑎𝑛𝑑 𝑂𝑟𝑠. 𝑉𝑠. 𝑆. 𝐽𝑎𝑛𝑎𝑘𝑖 𝑎𝑛𝑑 𝑂𝑟𝑠. Criminal Appeal No. 102 of 2011 Decided On: 20.03.2020 – on the refusal of Police to register FIR, 𝑪𝒐𝒎𝒑𝒍𝒂𝒊𝒏𝒂𝒏𝒕 𝑺𝑯𝑨𝑳𝑳 𝒂𝒑𝒑𝒓𝒐𝒂𝒄𝒉 𝑺𝒖𝒑𝒆𝒓𝒊𝒏𝒕𝒆𝒏𝒅𝒆𝒏𝒕 𝒐𝒇 𝑷𝒐𝒍𝒊𝒄𝒆 of his District. And 𝒐𝒏 𝒕𝒉𝒆 𝒇𝒂𝒊𝒍𝒖𝒓𝒆 𝒐𝒇 𝑺𝒖𝒑𝒆𝒓𝒊𝒏𝒕𝒆𝒏𝒅𝒆𝒏𝒕 𝒐𝒇 𝑷𝒐𝒍𝒊𝒄𝒆 𝒕𝒐 𝒅𝒊𝒓𝒆𝒄𝒕 𝒓𝒆𝒈𝒊𝒔𝒕𝒓𝒂𝒕𝒊𝒐𝒏 𝒐𝒇 𝑭𝑰𝑹, 𝑴𝒂𝒈𝒊𝒔𝒕𝒓𝒂𝒕𝒆'𝒔 𝑪𝒐𝒖𝒓𝒕 𝒉𝒂𝒔 𝒕𝒐 𝒃𝒆 𝒂𝒑𝒑𝒓𝒐𝒂𝒄𝒉𝒆𝒅. Any other course of action is #illegal. In the above matter, Supreme Court set aside the direction of High Court to register FIR because Complainant has approached High Court directly. 

The following is the law as laid down by Supreme Court :-
